Bodhi Counsel ("we", "us", "our") is committed to handling the personal information of those who engage with our practice in a careful and transparent manner. This policy describes what data we collect, how we use it, how long we retain it, and what rights you hold over it. Our practice is based at 224 North Sathorn Road, Silom, Bang Rak, Bangkok 10500, Thailand.
We process personal data in accordance with Thailand's Personal Data Protection Act B.E. 2562 (2019) and, where applicable to data subjects in the European Economic Area, the General Data Protection Regulation.
1. Data We Collect
We collect personal data in the following ways:
- Contact form submissions: name, email address, telephone number, and any information you include in your message.
- Engagement correspondence: information provided in the course of an advisory engagement, including business details, financial information, ownership structures, and supporting documentation.
- Website usage data: IP address, browser type, pages visited, and session duration, collected via analytics cookies where consent has been given.
We collect only what is necessary for the purpose stated. We do not purchase data lists or collect data from third parties without your knowledge.
2. How We Use Personal Data
We use the personal data you provide for the following purposes:
- Responding to enquiries submitted through our contact form or by email.
- Conducting the advisory engagement for which we have been retained.
- Maintaining records of advice given and documentation prepared, as required by our professional obligations.
- Sending engagement-related correspondence, including progress updates and follow-up questions.
- Improving the content and usability of this website, where analytics consent has been given.
We do not use your data for marketing purposes without your explicit consent. We do not sell personal data to third parties.
3. Legal Basis for Processing
We process personal data on the following legal bases:
- Contract performance: processing necessary to carry out an engagement you have requested.
- Legitimate interests: responding to pre-engagement enquiries and maintaining records of our professional activities.
- Consent: for analytics and non-essential cookies, where you have provided consent through the cookie preference controls on this website.
- Legal obligation: retaining records where required by applicable Thai professional standards or law.
4. Data Retention
Engagement files — including correspondence, advisory notes, and application documentation — are retained for seven years following the close of an engagement. This period reflects our professional obligations and the timeframe within which professional liability claims may arise under Thai law.
Pre-engagement enquiries that do not proceed to an engagement are retained for twelve months and then deleted.
Analytics data is retained for twenty-four months before being deleted or anonymised.
5. Cookies
This website uses essential cookies to support basic functionality and optional analytics cookies to understand how visitors use the site. A full description of the cookies we use and how to manage your preferences is set out in our Cookie Policy.
6. Data Sharing
We share personal data only in the following circumstances:
- With the Ministry of Commerce or the Board of Investment, where you have engaged us to submit an application on your behalf and the data is included in that application.
- With professional advisers (for example, translators or specialist co-counsel) engaged to assist with your matter, where sharing is necessary for the engagement and is subject to confidentiality obligations.
- Where required by law or a competent authority.
We do not share personal data with advertising networks, social media platforms, or data brokers.
7. International Data Transfers
Where clients are based outside Thailand and provide us with personal data in the course of an engagement, that data is transferred to Thailand for processing. We apply appropriate safeguards to such transfers in accordance with applicable data protection requirements.
8. Data Security
We hold engagement files on secure systems with restricted access. Electronic communications are handled via encrypted channels where possible. Physical documents containing personal data are stored in locked storage accessible only to engagement personnel.
In the event of a data breach that may affect your rights, we will notify you and the relevant supervisory authority as required by applicable law.
9. Third-Party Links
This website may contain links to external resources, including the Ministry of Commerce and Board of Investment websites. We are not responsible for the privacy practices of those sites and encourage you to review their policies directly.
10. Children's Privacy
Our services are intended for businesses and individuals above the age of eighteen. We do not knowingly collect personal data from minors. If we become aware that data has been submitted by a minor, we will delete it promptly.

Under the Personal Data Protection Act and, where applicable, the GDPR, you have the following rights:
- Access: to obtain a copy of the personal data we hold about you.
- Rectification: to correct inaccurate or incomplete data.
- Erasure: to request deletion of data we are not required to retain.
- Data portability: to receive your data in a commonly used format where technically feasible.
- Objection: to object to processing based on legitimate interests.
- Withdrawal of consent: where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
To exercise any of these rights, contact us at [email protected]. We will respond within thirty days.
If you consider that your data has been processed unlawfully, you may lodge a complaint with the Personal Data Protection Committee of Thailand or the supervisory authority in your country of residence.
